LucidCare Health, LLC is committed to protecting Protected Health Information (PHI) in accordance with HIPAA and its implementing regulations, including the HIPAA Privacy Rule (45 CFR Parts 160 and 164) and the HIPAA Security Rule.
What We Do
LucidCare Health provides AI-assisted tools and licensed clinicians that help patients understand their medical documents in plain language. In the course of providing these services, we may access, process, or transmit PHI on behalf of our customers.
Our HIPAA Obligations
As a Business Associate under HIPAA, we fulfill our role by:
Entering into Business Associate Agreements (BAAs) with all covered entity customers prior to accessing any PHI
Using and disclosing PHI only as permitted by applicable BAAs and HIPAA regulations
Implementing administrative, physical, and technical safeguards to protect ePHI
Training workforce members on HIPAA policies and procedures
Reporting confirmed breaches to affected covered entities within 60 days of discovery
Data Use
PHI is used solely to provide contracted services. We do not sell, rent, or disclose PHI for marketing or any purpose not authorized under a BAA or required by law.

Acceptance of Terms
By accessing or using LucidCare Health's website or platform (the "Services"), you agree to be bound by these Terms. If you do not agree, do not use our Services.
Description of Services
LucidCare Health is a patient advocacy service connecting individuals with licensed nurses and nurse practitioners for care coordination, health education, and patient support. LucidCare Health does not provide medical advice, diagnosis, or treatment.
Eligibility
Be at least 18 years of age
Have the legal authority to enter into a binding agreement
Comply with all applicable federal, state, and local laws
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access at info@lucidcarehealth.com.
Member Agreement and PHI
Access to your Protected Health Information by your LucidCare Health care team requires a signed Member Agreement. You may withdraw PHI authorization at any time by contacting us in writing.
Acceptable Use
You agree not to use the Services to violate any law, submit PHI without a signed Member Agreement, upload malicious content, attempt unauthorized access, or misrepresent AI-assisted content as professional medical advice.

AI-assisted content is for informational purposes only. It does not constitute medical advice or a substitute for professional medical judgment. All AI outputs are reviewed by licensed professionals.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. THE SERVICES ARE NOT A SUBSTITUTE FOR EMERGENCY MEDICAL CARE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.
Limitation of Liability
LUCIDCARE HEALTH'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Governing Law
These Terms are governed by the laws of the State of Ohio. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
Changes to These Terms
We may update these Terms at any time. Continued use of the Services after changes take effect constitutes acceptance.
