LucidCare Health, LLC ("we," "us," or "our") licenses care coordination software to care advocacy organizations, provider groups, and home health agencies, who self-host the platform in their own environment. For Licensed Deployments
Organizations that license the LucidCare Health platform handle PHI within their own self-hosted environment, subject to their own BAA with LucidCare Health, applicable HIPAA obligations, and (where LucidCare Health provides remote support) our related security and breach-notification commitments to that customer. Patients and families using a licensed deployment should refer to their care organization's own privacy notice for how their health information is handled.

LucidCare Health, LLC is committed to protecting Protected Health Information (PHI) in accordance with HIPAA and its implementing regulations, including the HIPAA Privacy Rule (45 CFR Parts 160 and 164) and the HIPAA Security Rule.
What We Do
LucidCare Health licenses a self-hosted care coordination platform — including AI-assisted plain-language document summaries, appointment coordination, and secure messaging — to care advocacy organizations, provider groups, and home health agencies, who deploy it in their own environment to coordinate care for the patients and families they serve. In the course of providing this software and any related support, we may access, process, or transmit PHI on behalf of our customers.
Our HIPAA Obligations
As a Business Associate under HIPAA, we fulfill our role by:
Entering into Business Associate Agreements (BAAs) with all covered entity customers prior to accessing any PHI
Using and disclosing PHI only as permitted by applicable BAAs and HIPAA regulations
Implementing administrative, physical, and technical safeguards to protect ePHI
Training workforce members on HIPAA policies and procedures
Reporting confirmed breaches to affected covered entities within 60 days of discovery
Data Use
PHI is used solely to provide contracted services. We do not sell, rent, or disclose PHI for marketing or any purpose not authorized under a BAA or required by law.

Description of Services
LucidCare Health licenses a self-hosted care coordination software platform to care advocacy organizations, provider groups, and home health agencies ("Customers"), who deploy it in their own environment to coordinate appointments, translate medical documents into plain language, and keep patients and families informed. LucidCare Health does not provide medical advice, diagnosis, or treatment, and is not a party to the clinical relationship between a Customer and its patients.
Eligibility
Be at least 18 years of age
Have the legal authority to enter into a binding agreement on behalf of yourself or your organization
Comply with all applicable federal, state, and local laws
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access at info@lucidcarehealth.com.
Licensing Agreement and PHI
Organizations that license the LucidCare Health platform must execute a license agreement and, where the platform will process Protected Health Information, a Business Associate Agreement (BAA) before accessing PHI. Customers are responsible for how their own advocates, providers, and staff use PHI within their self-hosted deployment.
Acceptable Use
You agree not to use the Services to violate any law, process PHI without an executed BAA where one is required, upload malicious content, attempt unauthorized access, or misrepresent AI-assisted content as professional medical advice.
AI-Assisted Content Disclaimer
AI-assisted content generated by the platform is for informational purposes only. It does not constitute medical advice or a substitute for professional medical judgment, and is intended to be reviewed by the Customer's own licensed care team before being shared with a patient or family.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. THE SERVICES ARE NOT A SUBSTITUTE FOR EMERGENCY MEDICAL CARE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.
Limitation of Liability
LUCIDCARE HEALTH'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Governing Law
These Terms are governed by the laws of the State of Ohio. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
Changes to These Terms
We may update these Terms at any time. Continued use of the Services after changes take effect constitutes acceptance.
